Information on data protection in CBBMR
In the data protection concept of CBBMR the basic principles of data protection measures and their technical implementation are laid down. The data protection concept has been approved by the data protection officer of the hospital and submitted to the Hessian data protection officer for examination.
In handling donor data, we have committed ourselves to the guidelines of the National Ethics Council NER. The data protection concept of Marburger Biobank is based on the legal requirements of the Hessian Data Protection Act, the Hessian State Hospital Act and the EU Data Protection Basic Regulation DS-GVO.
All employees of CBBMR who come into contact with personal identifying data of donors are subject to the obligation of secrecy. Donor and sample data only leave the biobank in pseudonymized, i.e. encrypted form.
Data protection clarification in accordance with the EU data protection basic regulation (DS-GVO)
According to the EU General Data Protection Regulation (GDPR), Article 12 ff): We are obliged to inform you about your rights in terms of data protection, who is responsible for data processing and whom you can contact if you have further questions can.
Legal basis
The legal basis for processing your personal data in the biobank is your voluntary written consent in accordance with the GDPR and the Declaration of Helsinki (declaration of the World Medical Association on the ethical principles for medical research on humans) and the guideline for good clinical practice.
With regard to your data, you have the following rights (Article 13 ff GDPR):
Right to information
You have the right to information about the personal data relating to you, which are collected, processed or, if necessary, transmitted to third parties within the framework of the biobank (provision of a free copy) (Article 15 GDPR).
Right to rectification
You have the right to have incorrect personal data concerning you corrected (Articles 16 and 19 GDPR).
Right to cancellation
You have the right to have your personal data deleted, e.g. B. if this data is no longer necessary for the purpose for which it was collected (Articles 17 and 19 GDPR).
Right to restriction of processing
Under certain conditions you have the right to request restriction of processing, i.e. the data may only be saved, not processed. You have to apply for this. For this purpose, please contact your examiner or the data protection officer of the test center (Articles 18 and 19 GDPR).
In the event of correction, deletion or restriction of processing, all those who have your data will be notified (Article 17 (2) and Article 19 GDPR).
Right to data portability
You have the right to receive the personal data concerning you that you have provided to the person responsible for the clinical study. You can then request that this data be transmitted either to you or, if technically possible, to another body named by you (Article 20 GDPR).
Right to object
You have the right to object at any time to specific decisions or measures to process your personal data (Art 21 GDPR). Such processing will generally no longer take place afterwards.
consent
The processing of your personal data is only lawful with your consent (Article 6 GDPR).
You have the right to withdraw your consent to the processing of personal data at any time. However, the data collected up to this point may be processed by the bodies named in the patient information and declaration of consent for the respective clinical study (Article 7, Paragraph 3 GDPR).
Notification in the event of a breach of the protection of personal data ("data protection breaches")
If a violation of the protection of personal data is likely to result in a high risk to your personal rights and freedoms, you will be notified immediately (Article 34 GDPR).
If you would like to exercise one of these rights, please contact the Marburger Biobank CBBMR or the data protection officer at your test center. You also have the right to lodge a complaint with the supervisory authority (s) if you are of the opinion that the processing of your personal data violates the GDPR (see contact details).
